This Addendum forms part of the Terms of Service between FinBaze Limited and the Customer. Capitalised terms have the meanings given in the Terms.
1. Customer responsibility
The Customer is responsible for Customer Data, instructions, users, connected services and its use of AI, automation, WhatsApp, APIs and Model Context Protocol (MCP).
The Customer must have all necessary rights, legal bases, consents and notices.
2. Prohibited use
The Customer must not use the Service to:
- violate laws, regulations, sanctions or third-party rights;
- facilitate fraud, deception, money laundering, tax evasion or other illegal activity;
- process harmful, defamatory, discriminatory, exploitative or otherwise unlawful content;
- distribute malware, bypass security or disrupt the Service;
- test vulnerabilities without prior written permission;
- scrape, collect or export data or non-public FinBaze material without authorisation;
- share credentials, access keys or accounts without authorisation;
- access data the Customer is not entitled to access; or
- resell the Service or build a competing product outside expressly permitted functionality.
3. Personal data
The Customer must not process children's personal data through the Service.
Special-category personal data may be processed only where strictly necessary and lawful, appropriate safeguards are in place and the use is consistent with the Service's purpose.
The Customer must minimise data and avoid providing sensitive information where less sensitive information is sufficient.
4. AI and automation
AI and automation outputs may be inaccurate, incomplete, outdated or misleading. The Customer must verify every relevant output before using it for bookkeeping, tax, legal assessments, payments, filings or other important decisions.
The Customer must not present AI as a qualified accountant, tax adviser, lawyer or human decision-maker.
Metered AI features, including automated purchase-invoice processing and AI letter extraction, are subject to the plan allowances and usage charges described in the Terms and the current price list. Using those features does not reduce the Customer's verification duties above.
FinBaze may use Customer Data to provide, secure, evaluate, improve and train its own models and product features as described in the Privacy Policy and DPA.
Under FinBaze's vendor arrangements, Anthropic, OpenAI, Google and Amazon do not use Customer Data submitted by FinBaze to train their general-purpose models.
5. WhatsApp and communication channels
The Customer must control who can access connected numbers, devices and conversations.
WhatsApp and similar channels must not be used for unnecessary sensitive information, children's data, unlawful content or information not intended for the recipients.
The Customer remains responsible for messages, attachments and actions sent or initiated through a connected channel.
6. MCP and external AI hosts
Where the Customer connects MCP, APIs or similar functions to an external AI host or automation service:
- the Customer selects and authorises that provider;
- the provider receives data under its own agreement with the Customer;
- the Customer must assess its security, retention, training use, regions and permissions;
- the Customer must limit permissions and revoke access when no longer needed; and
- FinBaze is not responsible for processing by that external host outside FinBaze's control.
7. Enforcement
FinBaze may investigate, restrict or immediately suspend use where it reasonably appears to involve illegal activity, abuse, a security risk or a material breach.
FinBaze may terminate the Agreement for a material breach in accordance with the Terms. Where appropriate, FinBaze will allow an opportunity to remedy the breach unless immediate action is needed to protect persons, data, FinBaze, providers or the law.
